1. Agreement to Terms

By accessing or using the MAPSCRAPX website (mapscrapx.com), web application dashboard, APIs, Google Business Profile (GBP) audit utilities, Geo-Grid rank trackers, and automated lead enrichment services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms apply to all visitors, registered users, digital marketing agencies, consultants, enterprise clients, and others who access or use the Service ("Users").

2. Service Description & SaaS Subscriptions

MAPSCRAPX provides a cloud-based B2B software-as-a-service (SaaS) platform for public business data discovery, local rank grid analytics, GBP health audits, and marketing workflow automation.

• Subscription Tiers: Access is provided on a recurring monthly or annual subscription basis (Starter, Pro Scale, Agency Suite, Enterprise) or Lifetime Deal (LTD) license tiers.
• Credit Allocation: Monthly plans include credit allowances for lead extraction and AI enrichment. Unused recurring monthly credits expire at the end of each billing cycle unless specified otherwise.
• SLA & Availability: We target a 99.9% platform uptime SLA. Scheduled maintenance is communicated via email or dashboard banners.

3. Account Registration & Security

You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your credentials and API keys. You agree to notify MAPSCRAPX immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Payment Processing, Invoicing & Renewal

Payments for MAPSCRAPX subscriptions, credit top-ups, and add-on services are processed securely through our Merchant of Record partners (including PaddleHQ) or direct wire transfer.

• Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours prior to the renewal date.
• Fee Adjustments: Price changes will be notified at least 30 days prior to taking effect. Continued use after price notification constitutes acceptance of new rates.
• Taxes: All fees are exclusive of applicable VAT, sales tax, or GST, which will be calculated and collected by our payment merchant based on your billing location.

5. Acceptable Use & Conduct Policy

You agree to use MAPSCRAPX strictly for lawful B2B marketing, research, and agency client management. You explicitly agree NOT to:

• Scrape non-public personal information or private individual data.
• Use extracted data to send unsolicited bulk spam (SPAM) in violation of CAN-SPAM, GDPR, or CASL laws.
• Attempt to reverse-engineer, decompile, or overload platform proxy queues or API infrastructure.
• Resell raw API access or sub-license account credentials without explicit written consent.

6. Intellectual Property Rights

The MAPSCRAPX platform, design assets, source code, logos, documentation, and original content remain the exclusive property of MAPSCRAPX and its licensors. You retain full ownership of all client reports, lead lists, and export files generated through your authorized use of the Service.

7. Limitation of Liability

To the maximum extent permitted by applicable law, MAPSCRAPX, its directors, employees, or partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your access to or inability to access the Service.
